Japan Gems is run by fivenine-design ("we"). This page says what we collect, why we collect it, where it is kept, and how to have it removed. It covers both the English site for visitors and the Japanese form used by businesses applying to be listed. 日本語はこのページの後半にあります。

What we collect

If you only read the site

Nothing that identifies you, unless you accept analytics. We do not require an account and we do not ask for your name or email to read anything.

Our web server keeps ordinary access logs (IP address, time, page requested, browser name) as any web server does. We use them to see whether the site is up and to spot abusive traffic. They are not used to build a profile of you.

If you accept analytics

We use Google Analytics 4 to count visits and see which pages are read. It is off until you accept it. The site loads with Google Consent Mode set to denied, so no analytics or advertising cookies are written before you choose. If you accept, Google receives your IP address (shortened by Google), the pages you view, and a randomly generated identifier stored in your browser. We never receive your name from this.

You can change your mind at any time by clearing this site's data in your browser, which removes the stored choice and returns the site to the denied state.

If you apply to have your business listed

The Japanese application form asks for, and we store:

  • Business name (Japanese and English), category, prefecture, city, address, website
  • Contact person's name, email address, telephone number
  • Your message to us
  • Photographs you upload
  • The IP address the form was sent from, and the date, time and version of the terms you agreed to

We keep the IP address and the record of consent so that, if there is ever a dispute about what was agreed, both sides can check.

Why we use it

  • To review your application and reply to you
  • To publish your listing on this site and in our app, if we go ahead
  • To keep a record of the permission you gave us to use your photographs
  • To keep the site running and defend it against abuse

We do not sell your information. We do not send marketing email to addresses collected through the form beyond replying about your application.

Where it is kept

Application data is stored in a database on a server in Singapore (DigitalOcean). Photographs are stored in DigitalOcean Spaces, also in Singapore, in a private area that is not publicly readable. Published listing photographs are served from a content delivery network.

If you are in the EEA or the UK, this means your information is transferred outside your region. We rely on your consent, given when you submit the form, together with the contractual protections in our agreement with DigitalOcean.

Who else sees it

  • Google — analytics, if you accept it, and embedded maps. Google's own privacy policy applies to what they collect.
  • DigitalOcean — as our hosting provider, they hold the servers and storage on our behalf.

We do not otherwise pass your information to third parties, except where we are required to by law.

How long we keep it

Applications are kept for as long as the listing is published, and for two years after it ends, so that we can show what was agreed. Access logs are kept for up to six months. Analytics data is kept according to the retention period set in Google Analytics, currently 14 months.

Your rights

You may ask us to show you what we hold about you, correct it, delete it, or stop using it. Write to [email protected] and we will reply. If you are in the EEA or the UK you also have the right to complain to your data protection authority.

Content on this site

Descriptions of places are written in English by us from facts drawn from Japanese sources, chiefly Japanese Wikipedia. Photographs come from Wikimedia Commons and are shown with their author and licence. This is not personal information about you, but we mention it so you know where the material comes from. If you are the subject of a photograph and want it taken down, write to the address above.

Changes

If we change this policy we will change the date at the top. Material changes affecting people who have already applied will be sent by email.

Japan Gems（運営: fivenine-design、以下「当方」）が、何を取得し、何のために 使い、どこに保管し、どうすれば消せるのかを記載します。閲覧される方と、 掲載をお申し込みいただく店舗様の双方が対象です。

取得する情報

サイトを読むだけの場合

解析に同意されない限り、個人を特定する情報は取得しません。閲覧に会員登録は 不要で、氏名やメールアドレスをお尋ねすることもありません。

web サーバは通常のアクセスログ（IPアドレス・日時・閲覧ページ・ブラウザ名）を 記録します。稼働の確認と不正なアクセスの把握に使うもので、個人の趣向を 組み立てる目的では利用しません。

解析に同意された場合

Google アナリティクス 4 を利用します。同意されるまでは動作しません。 Google 同意モードの既定を denied にしてあり、選択されるまで解析・ 広告用の Cookie は書き込まれません。同意された場合、Google に IPアドレス （Google 側で短縮されます）、閲覧ページ、ブラウザに保存される無作為の識別子が 送信されます。これらから当方が氏名を受け取ることはありません。

同意はいつでも撤回できます。ブラウザでこのサイトのデータを削除すると保存された 選択が消え、既定の「拒否」の状態に戻ります。

掲載をお申し込みいただいた場合

申込フォームで以下を取得し、保存します。

  • 店舗名（日本語・英語）、カテゴリ、都道府県、市区町村、住所、サイトURL
  • ご担当者名、メールアドレス、電話番号
  • ご記入いただいたメッセージ
  • アップロードされた写真
  • 送信元のIPアドレス、同意日時、同意いただいた文面の版

IPアドレスと同意の記録を残すのは、後日「何に同意したか」で認識の違いが生じた 際に、双方が確認できるようにするためです。

利用目的

  • お申し込み内容の確認とご返信
  • 掲載する場合の、本サイトおよびアプリへの掲載
  • 写真の利用許諾をいただいた記録の保管
  • サイトの運用と、不正なアクセスへの対処

取得した情報を販売することはありません。お申し込みへのご返信を超えて、 営業目的のメールをお送りすることもありません。

保管場所

申込内容はシンガポールにあるサーバ（DigitalOcean）の データベースに保管します。写真も同じくシンガポールの DigitalOcean Spaces の 非公開領域に保管し、外部から一覧・取得はできません。掲載する写真のみ、 配信網（CDN）を通じて公開します。

第三者への提供

  • Google — 同意された場合の解析、および地図の埋め込み。 Google が取得する情報には同社のプライバシーポリシーが適用されます。
  • DigitalOcean — 委託先として、サーバと保管領域を提供します。

法令に基づく場合を除き、これ以外に第三者へ提供することはありません。

保管期間

申込内容は掲載期間中および掲載終了後2年間保管します（合意内容を示せるように するため）。アクセスログは最長6か月です。解析データは Google アナリティクスの 保持期間（現在14か月）に従います。

開示・訂正・削除のご請求

保有する情報の開示、訂正、削除、利用の停止をご請求いただけます。 [email protected] 宛に ご連絡ください。ご本人であることを確認のうえ、遅滞なく対応します。 苦情のお申し出も同じ窓口で承ります。

掲載している内容について

観光地の説明文は、日本語版 Wikipedia などの日本語資料から事実を抽出し、 当方が英語で書き起こしたものです。写真は Wikimedia Commons のもので、 撮影者とライセンスを併記しています。これらは閲覧者の個人情報ではありませんが、 出所を明示するために記載します。写真に写っているご本人からの削除のご依頼は、 上記の窓口で承ります。

変更

本ポリシーを変更する場合は冒頭の日付を更新します。既にお申し込みいただいた 方に影響する重要な変更は、メールでご連絡します。
